Terms & Conditions

The agreement between you and EZ Cyber Guard for use of the Service.

Last updated 29 September 2026

1. Acceptance of these terms

These Terms and Conditions ("Terms") govern your access to and use of the EZ Cyber Guard website and the EZ Cyber Guard cybersecurity monitoring service (collectively, the "Service"), provided by EZ Solutions (Pty) Ltd, a company incorporated in South Africa.

By creating an account, starting a free trial, or otherwise using the Service, you ("Customer", "you" or "your") agree to be bound by these Terms. If you are accepting these Terms on behalf of a company or other legal entity, you confirm that you have the authority to bind that entity, in which case "you" refers to that entity. If you do not agree to these Terms, you must not use the Service.

2. The Service

EZ Cyber Guard provides continuous security monitoring for endpoints (computers and servers) that you enrol, built on EZ-Server. The Service includes, depending on your plan: alert monitoring, file integrity monitoring, vulnerability tracking, AI-assisted analysis and reporting, and automated response workflows.

EZ Cyber Guard is a monitoring and detection aid. It does not guarantee that all security incidents will be detected, prevented, or correctly classified, and it is not a substitute for your own information security policies, backups, or professional security advice where your circumstances require it.

3. Eligibility and your account

The Service is intended for use by businesses and their authorised personnel, not consumers acting for personal, household or domestic purposes. You must be at least 18 years old and legally capable of entering into a binding contract to create an account.

Notify us immediately at support@ezcyberguard.com if you suspect unauthorised access to your account.

4. Free trial

New organisations receive a 7-day free trial with full platform access and no card required to start. At the end of the trial period, you may choose a paid plan to continue. If you do not choose a paid plan, access to new actions such as agent enrolment and report generation is paused, though your existing security data remains safe and visible to yourself. We may change the length or availability of the free trial at our discretion.

5. Subscription fees and billing

Subscription fees are billed monthly (or annually, where offered) in South African Rand (ZAR), exclusive of Value-Added Tax, at the rate shown for your plan at the time of purchase. Payments are processed by Payfast (Pty) Ltd; EZ Cyber Guard does not see or store your card details.

Plans include a fixed number of endpoints; monitoring additional endpoints beyond your plan's allowance is billed at the published additional-endpoint rate. We may change our prices from time to time, but a price change will not apply to a billing cycle that has already started.

A subscription is only activated, and payment treated as received, once we have received and verified Payfast's payment notification for that transaction.

6. Cancellation, suspension and termination

You may cancel your subscription at any time from the Billing section of your account. Cancellation takes effect at the end of your current paid billing period; you retain access until then, and no further amounts will be charged afterwards.

If a payment fails or is not received, we may suspend the Service. Suspension does not delete your data — your existing security records remain safe and visible — but new actions (such as enrolling further devices, generating reports, or AI analysis) are paused until the account is brought current.

We may suspend or terminate your access, with notice where reasonably practicable, if you materially breach these Terms, use the Service unlawfully, or where required to protect the security or integrity of the Service or other customers.

7. Acceptable use

You agree not to, and not to permit anyone else to:

  • use the Service to monitor any device or network you do not own or are not authorised to monitor;
  • attempt to gain unauthorised access to the Service, other customers' data, or the systems underlying it;
  • reverse engineer, resell, sublicense, or white-label the Service without our written consent;
  • use the Service to develop a competing product, or in a way that infringes any law or third party's rights; or
  • interfere with or disrupt the integrity or performance of the Service, including through excessive automated use.

8. Your data and privacy

Our collection and use of personal information, including how we comply with the Protection of Personal Information Act 4 of 2013 (POPIA), is described in our Privacy & Cookie notice, which forms part of these Terms. You remain the owner of the security and configuration data generated through your use of the Service; we process it on your behalf to provide the Service and do not sell it.

9. Intellectual property

The Service, including its software, design, documentation and the EZ Cyber Guard name and branding, is owned by EZ Solutions or its licensors and is protected by intellectual property laws. Subject to these Terms and payment of applicable fees, we grant you a limited, non-exclusive, non-transferable right to use the Service for your internal business purposes for as long as your subscription is active. You retain all rights to your own data.

10. Third-party services

The Service relies on or integrates with third-party providers, including Payfast for payment processing and, where enabled, an AI provider for security analysis features. Your use of those integrations may also be subject to that provider's own terms. We are not responsible for the acts or omissions of independent third-party providers.

11. Availability and support

We aim to keep the Service available and to respond to support requests within a reasonable time, with response and resolution targets that vary by plan as described on our Pricing page. The Service may occasionally be unavailable for maintenance, upgrades, or reasons outside our reasonable control, and we do not guarantee uninterrupted or error-free operation.

12. Disclaimers and limitation of liability

To the maximum extent permitted by South African law, the Service is provided "as is" and "as available", without warranties of any kind, whether express or implied, including as to merchantability, fitness for a particular purpose, or that the Service will detect or prevent every security incident.

Neither party excludes liability for gross negligence, fraud, or any liability that cannot lawfully be excluded or limited under South African law, including the Consumer Protection Act 68 of 2008 where it applies. Subject to that, to the maximum extent permitted by law, EZ Cyber Guard's total liability arising out of or relating to the Service in any 12-month period is limited to the fees you paid to us for the Service in that period, and we are not liable for indirect, incidental, or consequential loss, including loss of profits, revenue, or data.

13. Indemnity

You agree to indemnify and hold EZ Cyber Guard harmless against any claim, loss, or expense arising from your breach of these Terms, your misuse of the Service, or your violation of any law or third party's rights, including monitoring a device you were not authorised to monitor.

14. Changes to these Terms

We may update these Terms from time to time, for example to reflect changes to the Service or the law. We will post the updated Terms on this page with a new "last updated" date, and for material changes we will make reasonable efforts to notify active subscribers. Continued use of the Service after a change takes effect constitutes acceptance of the updated Terms.

15. Governing law and disputes

These Terms are governed by the laws of the Republic of South Africa, including the Electronic Communications and Transactions Act 25 of 2002 and the Consumer Protection Act 68 of 2008 where applicable. The parties consent to the non-exclusive jurisdiction of the South African courts. Before litigating, the parties will first attempt in good faith to resolve any dispute through direct negotiation.

16. General

If any provision of these Terms is found unenforceable, the remaining provisions continue in full force. Our failure to enforce a provision is not a waiver of it. You may not assign your rights under these Terms without our consent; we may assign these Terms in connection with a merger, acquisition, or sale of assets. These Terms, together with our Privacy & Cookie notice, constitute the entire agreement between you and EZ Cyber Guard regarding the Service.
